What do dispute lawyers do?

How do you resolve a dispute without going to Court?
You can resolve a dispute without going to Court in a number of ways.
One way is through direct negotiation and mediation, which may result in a resolution. If a solution is found and agreed to, it should be put in writing and a copy provided to both parties.
If that doesn’t resolve the dispute, you could seek legal advice by the issuing of pre-action notices and pre-action meetings designed to try and resolve disputes before they proceed to Court.
However in some circumstances, further action may be required. Randle & Taylor Barristers & Solicitors recommend obtaining legal advice before proceeding with any further action.
What is Mediation?
The law in South Australia requires parties to try and resolve disputes before they proceed to Court. Mediation is a process where an independent person, known as the mediator, assists the parties to identify and assess options and negotiate an agreement to resolve their dispute.
Normally the parties share the expense equally of the mediator. In our experience mediation is successful at resolving disputes at least 80% of the time. It is much more affordable than litigation.
Mediation is an alternative to Court, where a judge imposes a decision on the parties.
