What does a family lawyer do?
A family lawyer can provide you with legal advice in relation to the distribution of property between you and your partner together with parenting and child custody advice. A family lawyer can represent you in the Federal Circuit and Family Court of Australia.
When should I speak with a family lawyer?
Ideally, as early as possible — even before separation. This helps to determine how the property of you and your former spouse or partner is to be distributed in the event that you separate and to understand how the law relates to ability to continue to care for your children if necessary.

Is there a time limit for property settlement after separation?
If you are in a de-facto relationship that has broken down you have two (2) years to finalise your property settlement from the date of separation.
If you are married and have separated, the time limit will apply after you have applied and have been granted a divorce.
If you have received a divorce certificate you have twelve (12) months to finalise your property settlement and/or spousal maintenance claim.
There are strict time limits that apply but if you have missed the due date you may be able to ask the Federal Circuit and Family Court of Australia for an extension of time to make an application for property settlement.

I am in a relationship, and I don’t want to leave my partner, but I want to protect my assets. What can I do?
The Family Law Act 1975 provides a way for people to continue to live together but enter into a Binding Financial Agreement as to how their property is to be distributed or protected upon separation.
How do I get a divorce?
To get a divorce in Australia you must meet the eligibility requirements to apply, namely at least one of the people in the relationship was born in Australia or an Australian citizen.
At least one person must have decided that the marriage has broken down and there is no reasonable likelihood that you will get back together.
You must have been separated for twelve (12) months and one (1) day or longer. You will need to have a copy of your marriage certificate.
If you have been married for less than two (2) years you will need to file a counselling certificate. To obtain a counselling certificate you will need to attend counselling. To arrange counselling please contact Family Relationship Advice Line 1800 050 321.
The court fee for a divorce is $1100.00 (this is subject to change) but if you may be eligible for a reduced fee of $365.00.
How can a family lawyer assist in property settlements?
A family lawyer can explain to you what factors are relevant, and therefore what factors are irrelevant in a property settlement. They can also provide you with strong representation to protect your rights and financial interests.
What about family mediation and court representation? Can you help?
A family lawyer can be extremely beneficial to you during a family mediation to try and resolve a dispute informally or during the family court process because the family court has a number of unique rules that make it difficult for many people to represent themselves in the family court.
Can a family lawyer help with international family law disputes?
Yes, a family lawyer can assist you to understand the unique rules that apply to international family law disputes and to find an international law firm to partner with and assist you to resolve your dispute.
How is child custody determined in family law?
Child custody is determined by what is in the best interest of the child or children. The paramount consideration is the safety and wellbeing of the child(ren) and to keep the child(ren) away from harm.
Other factors that the court is required to consider are the safety of the child(ren) including safety from being subjected or exposed to family violence, abuse, neglect, or other harm; the views expressed by the child(ren), the developmental, emotional and cultural needs of the child(ren), the benefit of the child(ren) being able to have a relationship with each of the parents and other significant people in the child(ren)’s life, anything else that is relevant to the particular circumstance of the child(ren), the capacity of the person who is proposed to have parental responsibility to provide for the child(ren) for their developmental, emotional and cultural needs.

The Family Law Court is a division of the Federal Circuit and Family Court of Australia (FCFCOA) that handles matters related to family law, including divorce, parenting arrangements, property disputes, and child support.
