We assist executors and administrators with Grant of Probate applications and estate administration throughout South Australia.
Grant of Probate Application
We assist executors with preparing and lodging the Grant of Probate application with the Supreme Court of South Australia, ensuring all documentation — including the original Will, death certificate and affidavit of executor — is complete and correct.
Do You Need Probate?
Not every estate requires a Grant of Probate. If the estate is valued at less than $15,000, or all assets pass by survivorship, you may not need one. We assess your specific circumstances and advise you before you commit to the application process.
Letters of Administration
If there is no valid Will — known as dying intestate — the next of kin can apply for Letters of Administration. We advise on eligibility and prepare the application so the estate can be administered in accordance with South Australian intestacy law.
Estate Administration
Once a Grant of Probate is issued, executors have significant legal obligations. We guide you through identifying and valuing assets, paying debts, notifying beneficiaries and distributing the estate correctly and in accordance with the Will.

Your Guide to Understanding Grant of Probate in South Australia
Everything executors and beneficiaries need to know about the Grant of Probate process in South Australia.
What is a grant of probate?
A Grant of Probate is a legal document issued by the Supreme Court of South Australia confirming that a Will is valid and granting the executor the legal authority to administer the deceased’s estate — including collecting assets, paying debts and distributing the estate to beneficiaries.
When is a grant of probate necessary?
You will need a Grant of Probate if third parties — such as banks, superannuation funds or the Land Titles Office — will not release the deceased’s assets without official confirmation of your authority as executor.
However, if the total estate is valued at less than $15,000, you may not need a Grant of Probate to realise the assets and distribute in accordance with the Will. We can advise you on whether probate is required based on the specific assets and circumstances of the estate.
If there is no valid Will — known as dying intestate — a Grant of Probate cannot be issued. Instead, the next of kin can apply for Letters of Administration to ensure the estate is administered in accordance with South Australian intestacy law.
What documents are required for a Grant of Probate in SA?
To apply for a Grant of Probate in South Australia, you will generally need to lodge the following with the Supreme Court:
- The original Will of the deceased
- The original death certificate
- An affidavit of executor confirming your identity and relationship to the deceased
- A statement of assets and liabilities of the estate
- The prescribed application form and supporting documents
Our solicitors prepare all documentation on your behalf, ensuring the application is complete and correct before lodgement.
What is the probate process in South Australia?
The Grant of Probate process in South Australia involves the following steps:
- Locating and reviewing the original Will
- Gathering asset and liability information for the estate
- Preparing the application, affidavit of executor and supporting documents
- Lodging the application with the Supreme Court of South Australia
- The Court reviews and, if satisfied, issues the sealed Grant of Probate
- Using the Grant of Probate to administer and distribute the estate — including presenting it to banks, the Land Titles Office and other institutions
How much does a grant of probate cost in South Australia?
The total cost includes Supreme Court of South Australia filing fees — scaled to the value of the estate — plus our professional legal fees.
| Gross Value of SA Estate | Court Filing Fee |
|---|---|
| Less than or equal to $200,000 | $957.00 |
| Greater than $200,000, but less than or equal to $500,000 | $1,914.00 |
| Greater than $500,000, but less than or equal to $1,000,000 | $2,549.00 |
| Greater than $1,000,000 | $3,826.00 |
Fees are indicative only and subject to change. Contact our office for current court fees and a clear estimate of our professional fees based on your specific circumstances.
How long does a grant of probate take in South Australia?
In South Australia, it typically takes 4 to 8 weeks to obtain a Grant of Probate after lodging the application with the Supreme Court, provided all documentation is in order.
However, the process can take longer where:
- The application contains incomplete or incorrect documentation
- The estate includes complex or disputed assets
- The Will is being contested by a beneficiary or other party
- There are difficulties locating the original Will or death certificate
Our solicitors prepare your application thoroughly from the outset, reducing the risk of delays caused by incomplete paperwork or requests for further information from the Court.
What happens after a Grant of Probate is issued?
Once a Grant of Probate is issued, the executor has legal authority to administer the estate. This involves:
- Notifying banks and financial institutions and presenting the Grant of Probate as proof of authority
- Collecting and consolidating all estate assets
- Paying outstanding debts, liabilities and taxes
- Transferring or selling property in accordance with the Will
- Distributing the remaining assets to beneficiaries
Can I apply for probate myself?
Yes, if you are the executor you can apply for probate personally via CourtSA, but the process can be complex. Many executors get a probate lawyer to manage the process and avoid delays. We are experts and can help you through the probate application and ensure accuracy and efficiency.
